Deux groupes de sept trafiquants de défenses d’éléphants ont été condamnés le 10 novembre 2021 par le tribunal de Première Instance de Kara, pour flagrant délit de détention, de circulation et de la commercialisation illégale de produits fauniques.
Sur les quatre trafiquants d’ivoire du premier groupe, arrêtés le 23 avril dernier à Kara, YOA Djima Didier et YOKOSSI Denis sont condamnés chacun à 36 mois d’emprisonnement avec 12 mois de sursis et avec deux millions de francs CFA d’amende chacun.
BADJASSAN Dimilina et BADJASSAN Dissirama, sont condamnés chacun à 16 mois de prison avec 10 mois de sursis et d’une amande d’un million de francs CFA chacun. Les quatre trafiquants sont enfin condamnés à payer solidairement à la partie civile une somme de 15 millions de francs CFA comme dommages et intérêts.
LAMBONI Mianam, faisant partie du deuxième groupe de trois trafiquants, a été condamnés à 18 mois de prison avec 12 mois de sursis en plus d’une amende d’un million de francs CFA. Les deux autres, MAÎGA Ibrahim, commerçant malien vivant au Bénin et NOUROU Abiboulaye, commerçant nigérien, basé à Kétao, ont été aussi condamnés chacun à 16 mois d’emprisonnement avec 10 mois de sursis et avec une amande d’un million chacun. Les trois trafiquants d’ivoire sont enfin condamnés à payer solidairement des dommages et intérêts de 15 millions de francs CFA à la partie civile.
Une décision obtenue grâce au soutien du Ministère de l’Environnement et des Ressources Forestières (MERF) en collaboration avec EAGLE-Togo, projet spécialisé dans la lutte contre le trafic international d’espèces sauvages protégées.
Dans la volonté du gouvernement et de la justice togolaise à combattre le trafic d’ivoire, les sept trafiquants d’ivoire ont écopé d’une peine prévue par la loi faunique togolaise suivant l’article 761 du code pénal : « La destruction et la commercialisation, directe ou indirecte, sans droit d’espèces animales ou végétales protégées en vertu des dispositions législatives et réglementaires en vigueur et des conventions internationales auxquelles la République du Togo est partie est punie d’une peine d’un à cinq ans d’emprisonnement et d’une amende d’un million à cinquante millions sans préjudice de toute autre disposition du présent code ».
Cette sanction est encourageante et démontre une vraie prise de conscience de la gravité des faits par le tribunal de première instance de Kara. Le Togo, conformément à ses engagements internationaux relatifs à la convention de Washington de 1977 portant sur le commerce international des espèces de faune et de flore sauvages menacées d’extinction, doit se faire le devoir de punir les trafiquants de produits fauniques avec rigueur et l’application effective de la loi par de fortes peines d’emprisonnement fermes, seul moyen de dissuader les trafiquants ou d’envoyer un message fort aux autres qui sont impliqués ou qui pourraient avoir l’intention de mener de telles activités illégales.
Le trafic d’ivoire génère d’énormes profits illégaux pour des organisations criminelles complexes qui sont souvent responsables de l’abattage des éléphants. Ce trafic porte atteinte à l’Etat de droit et contribue au financement du crime organisé et des groupes armés dans certaines régions.
Il est temps que ces criminels qui jalonnent les quatre coins du pays, soient jugés comme tels et que les sanctions appliquées par la justice soient exemplaires et dissuasives. Rappelons que les sept trafiquants d’ivoire une fois arrêtés, avaient avoué qu’ils ont fait venir les ivoires du nord du Bénin et du Burkina Faso.
