Mali / Sanctions : le gouvernement saisit la Cour de justice de l’Uemoa
Le gouvernement du Mali par le biais d’un collectif de six avocats, a saisi, la Cour de Justice de l’Union économique et monétaire ouest-africaine (Uemoa) de deux recours, contre les décisions issues de la Conférence des chefs d’États et de gouvernements de l’Uemoa en date du 9 janvier 2022, portant sanctions contre l’État du Mali, a annoncé, lundi, Moustapha S.M Cissé Avocat au Barreau du Mali.
L’UEMOA a imposé de lourdes sanctions économiques et financières au Mali après la volonté des dirigeants de prolonger la transition.
Dans un communiqué publié ce lundi, un collectif d’avocats du gouvernement malien annonce avoir porté plainte contre l’UEMOA devant la cour de la justice sise à Ougadougou.
« A la demande du gouvernement de la République du Mali, un collectif de six des Avocats Maliens conduits par Maître Moustapha S. M Cissé, Avocat au Barreau du Mali et Bâtonnier de l’Ordre des Avocats du Mali, a saisi la Cour de Justice de l’UEMOA de deux recours contre les décisions issues de la Conférence des Chefs d’États et de gouvernement de l’UEMOA en date du 9 janvier 2022 portant sanctions contre l’État du Mali », a expliqué la même source.
Selon Me Cissé, « le premier recours tend à obtenir de la Cour de Justice de l’UEMOA, sise à Ouagadougou au Burkina Faso, l’annulation des décisions sus visées ».
« Le deuxième recours tend à demander la suspension de l’exécution des sanctions eu égard aux effets gravement préjudiciables à l’État du Mali, aux populations maliennes et africaines vivant au Mali » poursuit-il.
Il indique, en outre, que « les deux recours ont d’ores et déjà été formellement enregistrés au greffe de la Cour de Justice de l’UEMOA le 15 février 2022 ».
Enfin, Me Moustapha S.M Cissé a ajouté que « tous évoquent l’illégalité absolue des sanctions au regard des textes et objectifs de l’UEMOA ».
Pour rappel, l’UEMOA avait annoncé le 9 janvier dernier, lors d’un sommet extraordinaire à Accra au Ghana, la suspension de toutes les transactions commerciales, à l’exception des produits de consommation essentiels : pharmaceutiques, fournitures et équipements médicaux, ainsi que le matériel pour le contrôle de la Covid-19 et des produits pétroliers et d’électricité.
Le gouvernement du Mali a, dès lors, invité instamment, l’Union Économique et Monétaire Ouest-Africaine (UEMOA) à se conformer aux règles communautaires et à lever les sanctions socio-économique imposées au Mali, dans l’esprit de justice, d’équité et de solidarité.
Pour le Premier ministre Choguel Kokalla Maiga, « la finalité des sanctions, illégales et illégitimes de la CEDEAO et de l’UEMOA est de déstabiliser l’Etat malien et d’achever un peuple déjà à terre. En comparant ces sanctions aux textes fondamentaux de ces organisations, vous vous rendrez compte qu’il y a eu un abus de pouvoir.
