Désactivation des Wifi-Zones dites « illicites » par Togocom. C’est « une activité licite au regard du cadre légal et réglementaire qui régit les communications électroniques au Togo… » (l’ARCEP)
L’Autorité de régulation des communications électroniques et des postes (ARCEP) vient de réagir à la récente décision de l’opérateur de téléphonie mobile et fournisseur d’accès internet au Togo, TOGOCOM relative à sa décision de désactivation progressive des Wifi-Zones taxée par la société « d’illicite ».
Dans un communiqué en date de mercredi 15 février 2023, elle a fait une mise au point en recadrant le débat.

Suite à la publication d’un communiqué de TOGOCOM au sujet du Wifi zone, l’Autorité de régulation des communications électroniques et des postes (ARCEP) tient à faire la mise au point ci-après.
L’activité du Wifi zone est une activité licite au regard du cadre légal et réglementaire qui régit les communications électroniques au Togo. En effet, au regard de la loi n°2012-018 du 17 décembre 2012 sur les communications électroniques (LCE) et du décret n°2014-088/PR du 31 mars 2014, portant sur les régimes d’activités des communications électroniques, l’activité du Wifi zone est une activité de fourniture de service à valeur ajoutée qui est régie par le régime de déclaration à l’ARCEP.
L’activité du Wifi zone n’est donc pas interdite par la réglementation en vigueur si elle est exercée conformément au cadre réglementaire, notamment la LCE, le décret sur les régimes, la décision n°226/ARCEP/DG/22 du 30 décembre 2022 sur les dispositifs composés d’appareils de faible puissance et de faible portée, prise en application de l’article 48 de la LCE.
L’ARCEP rappelle que le Wifi zone est un service qui participe à l’inclusion numérique en permettant aux consommateurs à faibles revenus d’accéder au haut-débit fixe à des tarifs beaucoup plus abordables que les tarifs prohibitifs en entrée de gamme de l’internet mobile au Togo.
En tant que garante à la fois du respect des droits des consommateurs et des conditions d’exploitation de réseaux et services sur le marché des communications électroniques, l’ARCEP invite, d’une part les fournisseurs d’accès Internet à proposer des offres alternatives favorables à l’activité du Wifi zone et, d’autre part les fournisseurs de service à valeur ajoutée à se conformer aux dispositions qui encadrent l’exercice de ces activités.
Togocom et l’Arcep parlent le même langage
La problématique ici tourne autour du cadre réglementaire de l’activité de Wifi Zone. Pour Togocom, utilisation détournée de ses offres initialement à usage domestique à des fins commerciales (wifi zone) rend illicite l’activité. Mais en soi l’activité même n’est pas illicite si elle est exercée dans un cadre réglementaire prévu par la législation. C’est le principe qu’a rappelé l ARCEP.
En définitive, pour que l’usage de la fibre de Togocom à des fins de Wifi zone ne soit plus illicite, il faudrait juste que les consommateurs ou plutôt les exploitants des Wifi-Zones se conforment à la législation qui encadre cette activité.
