Togo | Verdict-procès : assassinat du colonel Madjoulba Bitala et atteinte à la sûreté intérieure de l’État. Le Gle Abalo Kadangha écope 20ans de prison
Le tribunal militaire de Lomé vient de rendre son verdict dans l’assassinat du colonel Madjoulba Bitala et dans le dossier d’atteinte à la sûreté intérieure de l’État dans un procès qui a commencé depuis le 23 octobre 2023. Le principal accusé, le Général Abalo Kadangha, l’ancien d’Etat major général des Forces armées togolaises au moment des faits, écope de 20ans de réclusion criminelle.
Le verdict a été sans appel pour certains des accusés, tandis que d’autres ont été acquittés. Ce mardi 07 novembre, les 4h de plaidoiries des avocats des accusés commencé lundi 6 novembre, qui ont appelé à des décisions justes en acquittant leurs clients, n’auront pas suffi. Il aura fallu pour les juges et assesseurs de se retirer de 12h30 à 21h pour qu’enfin la sentence puisse se prononcer tard dans la nuit. Les avocats de la défense avaient demandé une contre-expertise, mais cette requête a été rejetée par le tribunal militaire de Lomé.
L’ancien chef d’Etat-major général des Forces armées togolaises (FAT) est déclaré coupable des faits de complot contre la sureté intérieur de l’Etat, de complicité d’assassinat et d’entrave au bon fonctionnement de la justice. Il bénéficie de circonstance atténuante. L’on se souvient que le procureur près du tribunal militaire, Mgt-Lcol Kpatchaa Melou, qui vraisemblablement, n’avait pas douté de la culpabilité des accusés avait requis une peine de 50 ans de réclusion criminelle contre ce dernier.
Le chauffeur du colonel Madjoulba, le caporal-chef Songuine Yendoukoa, considéré comme la pièce maitresse dans le dossier devra passer 15 années en détention. Le parquet militaire, qui le reconnaît comme l’auteur de l’assassinat de son chef, le condamne pour les crimes de complot contre la sécurité intérieur de l’Etat et d’entrave au bon fonctionnement de la justice.
Les autres accusés, toujours dans cette affaire d’assassinat du colonel Madjoulba Bitala, le Lieutenant-Colonel Ali Kodjo, déclaré coupable des faits de complicité d’assassinat, de complot contre la sureté intérieur de l’Etat, d’entrave au bon fonctionnement de la justice, passera également 15 ans de prison, tandis que le Commandant Bouwe, l’ex patron de l’Unité de Sécurité Militaire(USM), est quant à lui, condamné à 5 ans de prison, pour le chef de complot contre la sureté intérieur de l’Etat, d’entrave au bon fonctionnement de l’Etat.
La seule femme, soldate de 1ère classe Leilatou Akouna, secrétaire de la victime et accusée de complicité et écope 5 ans de réclusion criminelle. Elle est disculpée pour le chef d’accusation de faux témoignage.
Deux des accusés, le Commandant Atèkpe et le Colonel Agbonkou ont été acquittés et pourront réintégrer les rangs de l’armée togolaise.
Le tribunal militaire ordonne aux condamnés de payer une somme de 1 milliard de FCFA comme dommage et intérêt à l’Etat Togolais, initialement estimés à 10 milliards. Ils doivent également payer 1F symbolique à la famille Madjoulba.
Rappelons que les condamnés dans l’assassinat du chef du 1er Bataillon d’Intervention Rapide (BIR), et de complot contre la sécurité intérieure de l’Etat, dont Abalo Kadangha sont destitués et perdent leur qualité de militaire.
Le nouveau code de justice militaire prévoit la destitution d’un militaire
La destitution est bien prévue dans le nouveau code de justice militaire adopté le 27 décembre 2022, notamment en Livre troisième (des infractions militaires et des peines applicables). L’Article 134 de cette loi stipule : « La destitution consiste en un retrait de la qualité de militaire et de toute fonction y attachée. Elle emporte la perte totale de grade et du droit d’en porter les signes distinctifs, les insignes et l’uniforme. Elle ne fait pas obstacle aux droits acquis à pension. Elle est prononcée d’office pour les peines criminelles ou pour les peines d’emprisonnement d’au moins cinq (05) ans ». D’autres peines comme la perte totale ou partielle de grade, et des peines complémentaires sont également prévues.
Ainsi, le tout premier procès du premier tribunal militaire du Togo installé à Lomé, qui est celui de l’assassinat de Madjoulba Bitala et d’atteinte à la sûreté intérieure de l’État vient de prendre fin.
