L’homosexualité, une relation contre nature dans nos civilisations africaines. Une orientation sexuelle qui n’est pas en adéquation avec les valeurs sociales togolaises. Le ministre Christian Trimua devant le comité des droits de l’Homme ce mardi 29 juin 2021, a donné des précisions sur la position du Togo face à la question de l’homosexualité.
« Pour ce qui est des relations sexuelles entre adultes consentants du même sexe, le Togo n’envisage pas abroger les dispositions qui les criminalisent…. » a affirmé le ministre Trimua devant la présidente du Comité des Droits de l’Homme des Nations Unies, Mme Élisabeth TICHY-FISSLBERGER.
Selon le ministre, la non légalisation de cette loi est due aux respects de nos valeurs. « Le Togo n’envisage pas abroger les dispositions qui les criminalisent car cette orientation sexuelle n’est pas en adéquation avec les valeurs sociales togolaises » a-t-il laissé entendre
Pour rappel, le ministre a donné ces précisons lors de la présentation du 5eme rapport périodique du Togo sur la mise en œuvre du « Pacte International Relatif aux Droits Civils et Politiques ». La loi togolaise punit les actes homosexuels de trois ans d’emprisonnement et d’une amende de 100 000 à 500 000 francs CFA. Seul le mariage entre un homme et une femme est légal dans le pays. Même à ce niveau, l’article 42 du nouveau Code des personnes et de la famille établie la monogamie comme la règle et la polygamie comme l’exception
Dans de nombreux pays africains jusqu’alors muets sur le sujet, l’homosexualité n’est pas africaine. c’est une maladie venue d’ailleurs et ce n’est qu’une « déviance venue d’ailleurs » . Les raisons mises en avant sont de plusieurs ordres : religieux, moral ou traditionnel.
En Afrique sub-saharienne, l’homosexualité est largement criminalisée de façon officielle mais aussi officieuse dans plusieurs pays.
Les lois répriment cette orientation sexuelle, exposant la communauté LGBTQI+ à la stigmatisation et aux violences de tout genre.
Dans ces textes de loi et surtout le code pénal, cette orientation sexuelle est clairement définie comme une pratique ‘contre-nature’
Les officiers de police et les tribunaux ont donc de facto une prise de position ‘naturelle’ qui criminalisent les faits et gestes de toutes personnes identifiées comme étant gay, lesbienne, transgenre ou queer.
A ce contexte de loi défavorable s’ajoute le poids de la culture et souvent de la religion.
