Si depuis 2010 où a été adopté le Code de l’Eau, l’activité de foreur professionnel a été réglementée, c’est un arrêté pris récemment par Bolidja Thièm, ministre togolais de l’Eau et de l’hydraulique villageoise qui fixe de manière exhaustive, les conditions d’octroi des licences de foreur. Ceci devrait en pratique, réglementer l’exercice du métier de foreur, laissé ces dernières années au bon vouloir de ceux qui le pratiquent.
Depuis mercredi 05 mai 2021, le ministère de tutelle a rendu public une note circulaire, laquelle conditionne l’activité de foreur professionnel d’eau au respect de l’article 39 du Code de l’eau.
Il faut préciser que les entreprises de forage d’eau étant réparties en sept (7) catégories, sont classées relativement aux moyens humains et matériels dont elles disposent.
Ainsi, « la catégorie A dénommée artisan foreur, regroupe toute personne qui réalise des forages à petit diamètre ne dépassant pas 50 mètres. La catégorie B, rassemble toute personne physique ou petite entreprise capable de forer jusqu’à 150 m », renseigne la décision.
Quant aux catégories C et D, elles regroupent les entreprises moyennes pouvant forer respectivement 300 à 500 m tandis que les catégories E et F, regroupent les grandes entreprises et toute personne physique ou morale pouvant forer jusqu’à 700 mètres pour la première et plus, pour la seconde, informe la même source.
Au vue des nouvelles dispositions, l’exercice de l’activité de foreur n’est autorisée qu’après obtention d’une carte professionnelle délivrée par le ministère chargé de l’Eau selon la catégorie de l’entreprise et ce, après avis de la commission concernée par l’octroi de la carte.
Qui sont et comment sont classés les foreurs au Togo ?
Le foreur professionnel, exerçant son activité à des fins commerciales, selon le Code de l’Eau en vigueur au Togo, devra disposer d’une licence de foreur dont le présent arrêté du ministre fixe les conditions d’octroi.
D’après la nouvelle mesure, « l’exercice de l’activité de foreur n’est autorisé qu’après obtention d’une carte professionnelle délivrée par le ministère chargé de l’eau selon la catégorie de l’entreprise et ce, après avis de la commission concernée par l’octroi de la carte. La durée de validité de la carte professionnelle est fixée à deux ans renouvelables ». Une période grâce d’un an est accordée aux foreurs afin de se conformer aux nouvelles dispositions.
Notons par ailleurs qu’en accord avec les dispositions du Code de l’Eau, le ministre a adopté un arrêté dans lequel il établit le profil et la classification des foreurs d’eau en sept catégories, en fonction de leurs moyens matériels et humains, une sorte de « Who’s Who » des foreurs.
