Le Gouvernement semble oublier les acteurs de la topographie au Bénin suite à la réforme sur la Décentralisation de 2021-2022.
Suite à la prise de deux notes No 824 du 15 octobre 2021 du Ministre du Cadre de Vie et de Développement Durable José Tonato et celle No 974 du 20 novembre 2021 du ministère de la Décentralisation de la Gouvernance Locale de Raphaël Akotegnon, toutes les actualités sur le lotissement, remboursement, recasement et autres sont suspendues jusqu’à nouvel ordre.
Cette double suspension devrait être levée suite à la nomination des nouveaux Secrétaires Exécutifs (SE) des 77 mairies dans les 12 départements avaient révélé des sources concordantes et proches. Mais un an déjà, les chargés des travaux et les propriétaires terriens sont restés sur leur soif et la galère s’est mariée à eux. Depuis avril 2022, toutes les mairies ont connu chacune leur SE.
Et toutes les activités stoppées ont repris sauf celles des travaux de lotissements, remembrement, recasement et en général les travaux sur le foncier. Les jours passent mais les acteurs et usagers bloqués se donnent toujours espoir et la galère et la douleur persistent. Dans plusieurs Communes du Bénin, la plupart des SE n’ont même pas entamé la délivrance des actes sur le foncier. C’est un constat dans près de 50 Mairies sur les 77, selon une enquête du correspondant de TogoNyigba à Cotonou. Il faut rappeler que après la nomination des Secrétaires Exécutifs, les Maires ont été déchargés de la signature des actes fonciers et autres.
À part la législation, aucun Maire, autrefois tout-puissant, ne peut plus faire suite à cette réforme qui est entrée en vigueur depuis janvier 2022, avait annoncé TogoNyigba. Les travaux de lotissements en cours, bloqués, créent beaucoup de conséquences dans l’assainissement du Bénin. Après le lotissement et le recasement, une fois que les propriétaires connaissent leur emplacement, ils entament des chantiers de construction. Et cela fait développer la localité. Aujourd’hui, il y a un an déjà que tout est stoppé pour être repris quand ? Les géomètres, topographes et assimilés qui ont des contrats de lotissements dans les communes sont oubliés. Et ce secteur semble échapper aux ministres et au Gouvernement de Patrice Talon. Selon des sources concordantes, la levée de ces motions de suspension n’est plus pour maintenant.
Il faut encore attendre à partir de 2024. Car la loi sur le foncier d’août 2023 doit être appliquée six mois au moins avant toutes reprises des travaux de lotissements et autres. Et ce, à compter d’août 2023. Si des irrégularités sont toujours constatées en 2024, aucun privé ne peut exercer un travail de lotissement au Bénin même s’il avait déjà entamé avant la suspension. Et ce seraient à la charge de l’Institut National Géographique (IGN) et d’autres qui seront créés dans les mois à venir.
