La caution est la personne qui, dans un document écrit appelé acte de cautionnement, s’engage envers le propriétaire du logement loué à payer les dettes locatives du locataire. Il existe 2 formes de caution : la caution simple et la caution solidaire.
La présentation d’une caution par les locataires n’est pas une obligation légale. Mais un propriétaire-bailleur peut tout à fait exiger une caution à son candidat.
Caution simple :
la caution simple permet au propriétaire de faire appel à la caution uniquement si le locataire n’est pas en mesure de payer ses dettes locatives.
En cas d’impayé, le propriétaire doit donc d’abord s’adresser au locataire en lui envoyant un commandement de payer: L’huissier qui est chargé de rédiger cet acte doit en même temps en envoyer une copie à la caution. Si la caution n’a pas été informée par l’huissier, elle n’est pas tenue de payer les éventuels intérêts mis à la charge du locataire pour paiement tardif des dettes locatives.
Si, malgré cette démarche, le locataire ne parvient pas à payer ses dettes, le propriétaire doit s’adresser à la caution.
Il est recommandé au propriétaire de le faire par courrier recommandé avec avis de réception. Ainsi, il pourra prouver avoir fait la démarche auprès de la caution.
,Caution solidaire
La caution solidaire qui permet au propriétaire de faire appel directement à la caution dès le 1er impayé, sans même passer par le locataire et donc sans même rechercher si celui-ci pourrait payer. Autrement dit, peu importe si le locataire ne peut ou ne veut pas payer sa dette.
Notons que le type de caution choisi par le propriétaire est indiqué dans l’acte de cautionnement.
Toutefois, il ne faut pas confondre caution (personne ou organisme):

Augmentation de loyer
Pour accepter la proposition d’augmentation du propriétaire, le locataire doit lui faire parvenir son accord écrit au plus tard 4 mois avant la fin du bail. L’absence de réponse de la part du locataire vaut refus.
Si le locataire refuse ou ne répond pas au plus tard 4 mois avant l’échéance du bail: Date à laquelle expire le bail, compte tenu de la durée pour laquelle il a été signé, le propriétaire (ou le locataire) doit saisir la commission départementale de conciliation (CDC) pour trouver un accord sur le prix (procédure gratuite).
Si le désaccord persiste en dépit de l’intervention de la commission départementale de conciliation, le juge des contentieux de la protection du tribunal dont dépend le logement doit être saisi avant l’échéance du bail.
