Bénin/Chefferie traditionnelle: La commission chargée de l’élaboration du cadre juridique installée
Le président Patrice Talon a installé le 27 mai 2022, les membres de la Commission en charge de l’élaboration du cadre juridique de la chefferie traditionnelle ce vendredi, annonce le correspondant de TogoNyigba depuis Cotonou.
Au palais de la Marina à Cotonou, les membres de cette Commission ont pris reçu les lettres de mission en vue de sortir une proposition concrète sur la chefferie traditionnelle.
A la suite de sa rencontre avec une délégation de la Chefferie traditionnelle du Bénin le jeudi 03 mars 2022, le Président de la République, Monsieur Patrice TALON, a fait une promesse aux gardiens de la tradition ; celle de l’installation courant mai 2022, d’une Commission qui sera chargée d’élaborer les actes nécessaires pour réformer entièrement la chefferie traditionnelle et l’amener à jouer pleinement son rôle pour le développement et la stabilité du Bénin.
Et pour joindre l’acte à la parole, le Chef de l’État, au cours d’une séance de travail qu’il a eue ce vendredi 27 mai 2022 au Palais de la Marina, avec les membres de cette Commission, a procédé à leur installation. Cette Commission a été mise en place à l’issue du Conseil des ministres du mercredi 11 mai 2022 pour engager le travail de définition préalable du concept de chefferie traditionnelle, explorer toute la problématique qu’elle recouvre avant la saisine de l’Assemblée nationale pour le vote d’une loi organisant son régime juridique.
A l’occasion de cette rencontre, le Ministre du Tourisme, de la Culture et des Arts, Monsieur Jean-Michel ABIMBOLA a rappelé, dans son mot introductif, l’historique du processus ayant abouti à la mise en place de ladite Commission. S’adressant aux membres de la commission, le Président Patrice TALON a mis l’accent sur une fragilité de notre histoire qui réside dans le fait que tout n’est pas écrit et que la tradition orale au cours des transmissions peut connaître des biais. Il reconnaît que la mission qui leur est assignée est lourde, la responsabilité grande mais qu’il leur fait confiance car experts chevronnés en la matière.
Ainsi, il a explicité ce qui est attendu de la Commission et établi la mission en deux (02) grands volets. Pour le Chef de l’État, il s’agira, dans un premier temps, pour les membres de la Commission « d’essayer de rétablir la réalité de ce qu’étaient nos royaumes et la manière dont ils étaient administrés, les règles de succession… » Là-dessus, le Président Patrice TALON fait remarquer qu’il ne sera pas question de les moderniser mais plutôt de « réhabiliter ce qui se faisait pour rester conforme à nos traditions à l’exception de ce qui n’est plus compatible avec nos lois ».
Cette phase va s’achever par une évaluation du rapport qui établit ce que sera désormais l’organisation de la Chefferie traditionnelle au Bénin, la structuration et le mode de succession. Le deuxième volet sera constitué des réflexions autour des prérogatives de la chefferie traditionnelle. A ce niveau, le Président de la République a annoncé que des représentants des Institutions de la République vont s’adjoindre aux membres de la Commission. Ensemble, ils vont réfléchir et proposer le rôle de la Chefferie traditionnelle au sein de la République. Ici, le Chef de l’État esquisse des pistes. Il suggère de réfléchir à comment la Chefferie traditionnelle va contribuer à la cohésion sociale, aider dans les conciliations, ce qui peut lui être dévolu en matière de gestion de la cité et enfin de définir les moyens à mettre en place dans l’accomplissement de cette charge.
Composée de quinze (15) membres ayant des connaissances et des compétences en histoire, géographie, socio-anthropologie, droit et sur le sujet proprement dit, cette Commission présidée par le Professeur Albert Bienvenu AKOHA, a pour mission de :
- rédiger l’avant-projet de loi portant composition, attributions, organisation et fonctionnement de la chefferie traditionnelle ;
- élaborer des avant-projets de textes d’application de la loi.
Pour rappel, c’est à la faveur de l’adoption de la loi N° 2019-40 du 7 novembre 2019 portant révision de la loi N° 90-32 du 11 décembre 1990 portant Constitution de la République du Bénin que les députés de la 8ème législature ont réalisé le rêve longtemps nourri par les acteurs du pouvoir traditionnel. Ceci à travers l’introduction dans la Constitution modifiée de l’article 151-1 qui stipule que : « l’État reconnaît la Chefferie traditionnelle gardienne des us et coutumes dans les conditions fixées par la loi ».
Etaient également présents à cette rencontre, les Ministres Raphaël AKOTEGNON de la décentralisation et de la gouvernance locale, Alassane SEÏDOU de l’intérieur et de la sécurité publique, Séverin Maxime QUENUM de la justice et de la législation et du chef cabinet du Président de la République Wilson GAKPETOR.
Dans les mois à venir, les Rois, Chefs traditionnels et autres recevront la proposition de la commission qui sera appréciée par Patrice Talon.
