La Cour européenne rejette les plaintes déposées contre le Vatican
Le Saint-Siège dispose d’une immunité reconnue par les principes de droit international
L’intouchable Vatican. La Cour européenne des droits de l’homme (CEDH) a débouté ce mardi 24 plaignants qui voulaient poursuivre le Vatican pour des actes de pédocriminalité commis par des prêtres catholiques. La Cour qui s’exprimait pour la première fois sur ce sujet a justifié sa décision en mettant notamment en avant « l’immunité » du Saint-Siège reconnue par les « principes de droit international ».
Les requérants, de nationalité belge, française et néerlandaise, avaient déjà été déboutés par les tribunaux belges qui avaient déjà invoqué cette « immunité de juridiction » du Vatican. Devant la CEDH, ils poursuivaient donc la Belgique, estimant que le rejet de leur action au civil les avait empêchés de faire valoir leurs griefs contre le Vatican. Pays non-membre du Conseil de l’Europe, donc hors du champ de la Cour européenne, le Saint-Siège n’était pas directement visé par la procédure devant la CEDH, bras juridique du Conseil. La Conférence épiscopale de Belgique et le Vatican avaient toutefois été autorisés à intervenir dans la procédure écrite en tant que tiers intervenants.
